Scope and acceptance of the Terms and Conditions

 

These Terms and Conditions apply to the purchase of products offered on Hermes-editeur.com.Products ordered on Hermes-editeur.com are exclusively intended for sale to end consumers, whether individuals, companies or organisations, to the exclusion of all retailers or agents acting on behalf of retailers. Any customer ordering products from the Hermes-editeur.com website represents to be acting as an end consumer and not a retailer or agent of a retailer, an essential condition for acceptance of any order by HERMÈS SELLIER.

HERMÈS SELLIER may update these Terms and Conditions at any time. You can view the most current version of the Terms and Conditions at any time by clicking on the link "customer service". The Terms and Conditions of sale in force at the time of concluding the contract of sale are those that apply to you.

Furthermore, for every order made on the Hermes-editeur.com website, you will be asked to confirm your acceptance of the Terms and Conditions in force on the date your order was placed.

Availability

 

Products and prices are valid as seen on the Hermes-editeur.com website, subject to availability. Exceptionally, errors or amendments may be made, especially in cases of simultaneous orders of the same product by several customers. If a product is unavailable after ordering, you will be informed by e-mail or by phone as soon as possible. You will then have the opportunity to either order an alternative product from the Hermes-editeur.com website or cancel your order.
If you choose to cancel your order, you will be immediately refunded if your credit or debit card has been debited.
HERMÈS SELLIER shall not be liable for a lack of stock or the unavailability of products. HERMÈS SELLIER reserves the right to change at any time and without any prior notice to you the items proposed on the Hermes-editeur.com website.
In order to ensure better service quality and greater availability of our products for all customer of the  Hermes-editeur.com website, HERMÈS SELLIER reserves the right to limit the number of products which can be purchased by a customer, in accordance with the provisions applicable to this effect and, in particular, those contained in Article L122-1 of the French “Code de la Consommation”.

For each Hermès product selected on the Hermes-editeur.com website, a summary page of your final order will be automatically displayed featuring a photograph of the item, its colouring, its references, the quantity selected, its unit price and the total amount for your order. You should check that this information accurately reflects your selection before confirming your order.
While every effort is taken to try and ensure that the colouring, design and style of the Hermes products in the photographs displayed on the Hermes-editeur.com website represent the original products, variations may occur due to various technical restrictions of colour reproduction on computer equipment. Accordingly, neither HERMÈS SELLIER nor HERMÈS INTERNATIONAL shall be liable for any errors or inaccuracies in the photographs or graphical representations of Hermès products displayed on the Hermes-editeur.com website. If you have any questions about the products, you may of course contact our Customer Service Department.
For every order via Internet, you must provide full, complete and accurate information during the ordering process. The information requested shall include: title, surname, first name, phone number, e-mail address, delivery and invoicing address. By providing us with this information you give your consent to Hermès to use and disclose your personal information for the invoicing, transport and delivery of Hermès products ordered on the Hermes-editeur.com website only.
For any gift order, you will be given the opportunity to include a covering card with a maximum of 12 lines for occidental characters or 9 lines for japanese characters. At the end of the ordering process, you are invited to click on the "pay and complete your order" button. When clicking on the "Pay and complete your order" button, you will be asked to accept in full these General Terms and Conditions of Sale and Use and the Privacy Policy of the Hermes-editeur.com website. When finished, your order is transmitted to HERMÈS SELLIER for processing. You may only modify or cancel your order by contacting the Customer Services Department by phone on +33(0)1 49 92 38 92 or e-mail.

HERMÈS SELLIER reserves the right not to accept an order from a customer with whom it has an ongoing dispute concerning a prior order, or if HERMÈS SELLIER reasonably believes that said customer has violated these Terms and Conditions or that the customer is engaged in fraudulent activity, or for any other legitimate reason.
A summary of your order will be sent to you by email. Your order confirmation will summarise the main characteristics of the Hermès products selected, the quantity, the price and the postage amount. We recommend keeping this confirmation on paper or electronically.

You can create an account in order to save your invoicing and delivery information for future orders. You will be asked to create your own password for subsequent use of the account.
You shall be kept fully responsible for keeping your login information safe and confidential and to never communicate it to any third parties. Accordingly, any purchase made using the login information is presumed to be done by you as the owner of the login information. If your password is lost, stolen or used fraudulently, you must inform our Customer Services Department immediately.

You may, at any time, deactivate your account by sending an e-mail to the Customer Services Department. After deactivating your account, you are free to create a new one at your convenience.
Any data recorded by the Hermes-editeur.com website will establish proof of transactions operated between HERMÈS SELLIER and its customers. In the event of a dispute between HERMÈS SELLIER and one of its customers about a transaction made on the Hermes-editeur.com website, the data recorded by HERMÈS INTERNATIONAL will be considered as irrefutable proof of the content of the transaction.
In accordance with article L. 134-2 of the French “Code de la Consommation”, when an order concerns an amount equal to or is greater than 120 Euros, HERMÈS INTERNATIONAL shall retain the document that embodies the contract concluded between HERMÈS SELLIER and a customer electronically for a period starting from the conclusion of the contract until the date of delivery of the product and for a period of ten (10) years from this date (in accordance with decree 2005-137 of 16 February 2005). You shall have access to this document at any time upon request by contacting editeur-en@hermes.com, and by proving us with a proof of your identity such as a scanned copy of your ID card or passport.

 

Price - Payment

 

The prices of Hermes products are in Euros, inclusive of taxes. Apart from cases of refunds given (i) in connection with the exercise of the right of withdrawal or (ii) for a lack of conformity or latent defects, HERMÈS SELLIER will not refund the VAT charged on purchases made through Hermes-editeur.com (even if the buyer, upon receipt, redirects the Products to a country outside the European Union). The final amount of your order includes the delivery fee in accordance with your chosen delivery option (see "Shipping Costs and delivery").
HERMÈS SELLIER reserves the right to amend at any time and without any prior notice to you the prices of the Hermès products on the Hermes-editeur.com website. The invoicing of the products is based on a price list posted on the Hermes-editeur.com website at the time of the order, subject to the availability of the products ordered at the time.
Any order placed on the Hermes-editeur.com website has to be paid for, immediately at the time of ordering. We only accept payments by credit or debit card. You may not use customer credit offered by Hermes stores or gift cards issued from Hermes stores for purchasing items on the Hermes-editeur.com website.
All orders are payable in Euros. We only accept payments by Mastercard®, Visa® and American Express®. Your order will be dispatched once your payment has been accepted.
Your credit or debit card will have been debited by the time the goods are dispatched. If any of the ordered products are unavailable (see "Availability" above), only the price and the delivery costs of the available products will be debited.

 

Retention of title

 

Any Hermès products ordered remain the sole property of HERMÈS SELLIER as legal and equitable owner and no property in or title to the ordered products shall pass to the customer until full payment for the products has been received by HERMÈS SELLIER.
However, you assume all risks (including loss, theft or damage) relating to the delivered products from the time they are delivered to the address specified at the time of order.

Goods will be shipped to the delivery address(es) specified during ordering.

Deliveries within the following countries are only available at Hermes shops:

It is impossible to order at any delivery address that is not listed in the countries above.

For security reasons, HERMES SELLIER will not process any order for which a general delivery address or PO Box is provided.

 

Shipping costs

 

Shipping cost fees are free on Hermès Editeur. Duties on import are calculated according to the products ordered and the shipping country selected.

Duties on import for an order containing a scarf and its associated book.

If your order contains more than one scarf, the duties on import will be multiplied by the number of scarves ordered.

Shipping fees if your order contains only one book: The shipping fees for the book "Variations autour de la longue marche de Julio Le Parc" are free

 

Time required for delivery

 

During the ordering procedure, we will inform you of the time required for delivery and the various forms of delivery available (as well as any delivery costs) for the products purchased.
You shall have to pay this amount in addition to the price of the products purchased.

 

Delivery to France and Monaco:
Chronopost Express:

4 business days after your order date for orders made before  2pm on a working day.
5 business days after your order date for orders made after 2pm on a working day.

Delivery to Corsica Island: 5 business days following your order.

Delivery to the United Kingdom:
Fedex Express: All orders placed before 1 p.m. on a business day will be delivered within 5 business days following your order. All orders placed after 1 p.m. on a business day shall be delivered within 6 business days following your order.
For delivery to the Scilly Islands: 6 business days following the order.
For delivery to the Orkney Islands: 7 business days following the order.
For delivery to the Hebrides: 8 business days following the order.
For delivery to the Shetland Islands: 9 business days following the order.

 

Delivery to Germany, Belgium, Luxembourg, Netherlands, Spain, Italy, Ireland, Austria, Finland, Greece and Portugal:
Fedex Express: All orders placed before 2 p.m. on a business day will be delivered within 5 business days following your order. All orders placed after 2 p.m. on a business day shall be delivered within 6 business days following your order.

 

Delivery to Singapore, Hong Kong, Macao, South Korea and the United-States:
Fedex Express: All orders concerning a delivery to these countries will be delivered within 8 business days following your order. The time required for delivery to these countries may change due to the procedures of custom clearance and/or force majeure (climate, strike …)

 

Delivery to Japan:
Fedex Express: All orders concerning a delivery to Japan will be delivered within 11 business days following your order. The time required for delivery to this country may change due to the procedures of custom clearance and/or force majeure (climate, strike …)

 

HERMÈS SELLIER reserves the right to divide your order into multiple shipments. Your credit or debit card shall then be charged accordingly to correspond to the price of products actually shipped. The shipping costs shall only be charged for a single shipment in accordance with the information contained in your order summary.

Saturday, Sunday and public holidays are not considered business days.

 

Delivery problems

 

Any failure or delay in the delivery or the availability of your products in store, that exceeds the delivery times mentioned in the "Delivery times" section, must be reported to our Customer Service department as soon as possible. Any claim made beyond thirty (30) calendar days after the date of confirmation of your order will not be taken into account.

HERMÈS SELLIER will then be required to refund the full amount paid at the latest within a period of fourteen (14) days following the date of termination of the contract of sale. If you still receive the Product after taking this option, you must return it under the conditions given in the "Returns - Exchanges - Refunds" section.

You must check the conformity of the products at the time of delivery and notify us of any anomalies (open package, damaged product etc.), if possible by writing your reservations on the delivery slip along with your signature.

You must then contact our Customer Service department by email, by clicking on "customer service" link, or by phoning +33 (0) 1 49 92 38 92, from Monday to Friday (excluding public holidays) from 10.30am - 6.30pm. In the event of non-conformity of the products purchased or if you are not satisfied with them, you may return them or request an exchange or refund as stipulated in the "Returns - Exchanges - Refunds" section.

 

Right of withdrawal

 

You have a legal right of withdrawal, which you may exercise as provided by Articles L121-21, L121-21-1 and L121-21-2 of the French Consumer Code, as long as you meet the conditions imposed by those provisions, without having to give any reason or pay any penalties.The HERMÈS SELLIER refund policy allows you to withdraw within fifteen (15) calendar days from the date of delivery of goods without any reason and without having to pay a penalty. After this time, you can no longer exercise your right of withdrawal.

As part of exercising your right of withdrawal or in the event of non-conformity of the delivered product, you may return the product(s) purchased and request an exchange or refund under the conditions described in the "Returns - Exchanges - Refunds" section below.

 

Returns - Exchange - Refunds

You are entitled to return any product ordered via the Hermes-editeur.com website within the fifteen (15) calendar days following the date of delivery, subject to the following terms and conditions: Items must be returned in their original condition and with their original complete packaging and any related accessories to the following address: Service Hermes-editeur.com, 24 rue du Faubourg Saint-Honoré, 75008 Paris.You must enclose the original invoice with your returns or a copy if you are returning part of your order.You shall bear all costs relating to returned product(s).

Third party beneficiaries of gifts ordered from the Hermes-editeur.com website can only exchange products. Only the customer who purchased the gift may request a refund under the right of withdrawal.

For items received as a gift obtained from the Hermes-editeur.com website, you are only entitled to a merchandise exchange.

In the event of an exchange:
- If the amount of the product(s) selected in replacement is greater than the amount of the product returned, you will have to pay the price difference in accordance with these Terms and Conditions.
- If the amount of the product selected in replacement is less than the amount of the product returned, the price difference will be refunded by HERMÈS SELLIER (bearing in mind that for gifts, only the customer who purchased the gift may request the refund and have their bank account credited) in accordance with these Terms and Conditions of Sale, except for a gift order.
You must fill-in and send the "Return Card" included with your order specifying whether you wish to exchange the goods returned or require a refund. If you would like to exchange products, the shipping costs for the first delivery will be refunded. However, you will be charged for the shipping costs of the second delivery.
If you ask for a refund, you are entitled to return any ordered product(s) on the Hermes-editeur.com website within fifteen (15) calendar days from the delivery date. The products have to be returned in their original condition and with their original complete packaging and any related accessories. In accordance with the law, the refund will be made within fourteen (14) days after either (i) the receipt of evidence of shipment of the product(s), or (ii) receipt of the product(s), whichever occured first. The refund, including the standard delivery charge of the initial order, will then be made via the same payment method used at the time of the order.However, please note that your bank may take extra time to carry out the refund

HERMÈS SELLIER will use all commercially reasonable efforts to ensure that any refund is made within fifteen (15) business days following the receipt of the product(s) returned on the original form of payment used to purchase the product(s).

Under no circumstances will it be possible to grant you an electronic credit usable on the Hermes-editeur.com website, nor will the website issue a store credit for use in an Hermes store.
In any event, reimbursement will occur no later than fourteen (14) days after notification of your right of withdrawal.
We do not issue refunds, even in part, if the product you wish to return was received by you as a gift.
In case of a claim made under the right of withdrawal, the shipping costs charged by Hermes will be refunded in full on the original form of payment used to place the order.
If the product(s) are not as you ordered (e.g., product reference error, damaged goods, etc.) any shipping costs incurred by you in returning the product(s) to Hermès will be refunded to you on the original form of payment used to order the Product(s). 
HERMÈS SELLIER shall not be responsible or liable if any product you wish to return to the Hermes-editeur.com website is lost, misdirected or returned after the prescribed period of fifteen (15) calendar days insofar as you have to bear the risks of the shipping you have chosen.
We do not currently exchange or allow refunds for product(s) purchased in Hermes stores via the Hermes-editeur.com website.

 

To Hermes stores

You may not exchange or request a refund to any Hermès stores for products purchased on the Hermes-editeur.com website. In order to be refunded for a product purchased on the Hermes-editeur.com website in accordance with your rights of withdrawal, please proceed as per our Returns-Exchange-Refund article above.

 

Legal warranties

 

Products sold by HERMÈS SELLIER are subject to the terms of legal guarantees laid down in Articles L 211-4 to L 211-13 of the French Consumer Code, as well as in Articles 1641 to 1648 of the Civil Code,  to the exclusion of any other guarantees:

 

- Legal guarantee of conformity: 

HERMÈS SELLIER will deliver a product to you that is consistent with the sales contract and free from any defects upon delivery of said product, in that the product will be fit for the use normally expected of a similar product and will present the characteristics outlined at the time of sale. HERMÈS SELLIER is also accountable for any defects resulting from packaging, assembly instructions or installation when this was assigned to it by the contract or was carried out under its responsibility. This guarantee only comes into effect on the condition that you make the request within a period of two years of delivery of the goods. Any defects which appear within six (6) months (period legally increased to twenty-four (24) months from 18 March 2016) of delivery are presumed to have existed at the time of delivery, unless proven otherwise. 
You can choose between the repair and replacement of the product unless one of these options leads to a manifestly disproportionate cost for HERMÈS SELLIER. If it is not possible to repair or replace the product, you can be refunded for the price paid and return the product, or keep the product and receive a refund for part of the cost, unless the defect is minor. The return, replacement or refund of the product will be at no cost to you and does not preclude the possible allocation of damages in the event you are entitled to these.  

- Warranty against latent defects: 


The product provided by HERMÈS SELLIER will be free of any latent defects that may render it unfit for its intended use, or diminish this use to the extent that you would not have purchased it, or would have paid a lower price if you had known. This warranty will only apply if you make the request within two (2) years of discovering the defect. In the event of a latent defect, you can choose to return the product and receive a refund for the price and costs arising from the purchase, or keep the product and receive a refund for part of the price. In all cases, it is your responsibility to prove that you fulfil the warranty conditions.

After-sales service

 

Given the nature of the products sold on the Hermes-editeur.com website, they are not deemed repairable.
Pursuant to Article L 111-3 paragraph 1 of the French Consumer Code, HERMÈS SELLIER cannot guarantee a period of availability for spare parts required for the use of products. Nevertheless, HERMÈS SELLIER will do its utmost to satisfy its customers in the event that one or more parts is requested.

 

Limitation of Liability

 

HERMÈS SELLIER shall not be liable for any indirect, incidental, special or consequential damages, including, without limitation, loss of profits or other intangible losses, arising out of or in connection with your use or inability to use the Hermes.com website.

 

 

Applicable Law - Disputes 

 

These General Terms and Conditions of Sale and Use shall be governed by and construed in accordance with French law without consideration of the principle of conflict of laws. These General Terms and Conditions of Sale do not obstruct compliance by the Hermes-editeur.com website of public policy provisions of regulations of a European Union country from which the customer has ordered subject to him/her being legally domiciled there.
In the event of a discrepancy between the General Terms and Conditions of Sale in the English language and the General Terms and Conditions of Sale in French, the latter shall prevail.
In the event of dispute, in accordance with the provisions of Regulation No. 44/2001 of 22 December 2000:
    - You can either seize the courts where you are domiciled, or the French courts,
    - HERMES INTERNATIONAL and / or Hermes Sellier may seize the courts where you are domiciled.
HERMES INTERNATIONAL reserves the right to seek and obtain injunctive or other equitable relief to protect its rights hereunder.
